Privacy Policy

1. Introduction

This privacy policy applies to the WorkoutNow app (hereby referred to as the "Application") for mobile devices that was created by Dilziyodbek Usmonov (hereby referred to as the "Service Provider") as a Freemium service. This service is intended for use "AS IS".

2. Information Collection and Use

The Application collects information when you download and use it. This information may include, for example:

  • Your device's Internet Protocol address (e.g. IP address)
  • The pages of the Application that you visit, the time and date of your visit, and the time spent on those pages
  • The total time spent in the Application
  • The operating system you use on your mobile device

The Application does not gather precise information about the exact location of your mobile device.

The Application may collect your device's approximate location, which helps the Service Provider determine your general geographical area and use it in the following ways:

  • Geolocation services: To provide features such as personalized content, relevant recommendations, and other location-based services.
  • Analytics and improvements: Aggregated and anonymized location data may be used to analyze user behavior, identify trends, and improve the overall performance and functionality of the Application.
  • Third-party services: Periodically, anonymized location data may be transmitted to external services that assist the Service Provider in enhancing the Application and optimizing their offerings.

The Service Provider may use the information you provide to contact you from time to time with important information, required notices, and marketing promotions.

For a better experience while using the Application, the Service Provider may require you to provide certain personally identifiable information, including but not limited to your email, age, gender, and weight. The information requested will be retained by the Service Provider and used as described in this privacy policy.

2.1 Health Data Collection

Health data is collected through the Application, Google Health Connect, and Apple Health. The data collected through the Application may include health-related information such as physical activity, calories burned, weight, height, nutrition, heart rate, and steps.

2.2 Usage of Health Data

We collect health data to enhance your overall experience, offering personalized health insights and fitness recommendations designed to help you achieve your health goals. These data points allow us to generate detailed health reports and recommendations tailored to your activity patterns and health status, assisting in crafting the most effective exercise programs for you.

2.3 Anonymous Account Creation and Cloud Data Synchronization

Upon the first launch of the Application, an anonymous user account is automatically created in order to support core functionality. This anonymous account allows the Application to store exercise-related settings, body metrics, and other usage preferences necessary for personalized recommendations and proper application behavior.

If you later choose to sign up or sign in, this previously created anonymous account and all related data may be linked to your registered account. This linking allows your data to synchronize across devices, enables secure cloud backup, and ensures that your Application experience remains consistent if the Application is reinstalled or accessed from another device.

The following information may be stored under the anonymous account before user registration or login:

  • gender
  • age
  • weight
  • height
  • birth month
  • workout preferences (including, but not limited to, favorite exercise)
  • training history and exercise-related settings

Cloud synchronization is enabled by default after account registration. You may disable synchronization at any time within the Application settings. If synchronization is disabled, data will remain stored only locally on your device and will not be backed up or transferred to the cloud.

We do not use anonymous account data to personally identify you.

Once an anonymous account is linked to a registered account, its data may be treated as personal information in accordance with this Privacy Policy.

3. Third Party Access

Only aggregated, anonymized data is periodically transmitted to external services to aid the Service Provider in improving the Application and their service. The Service Provider may share your information with third parties in the ways that are described in this privacy statement.

Please note that the Application utilizes third-party services that have their own privacy policies about handling data. You can review them here:

  • Google Analytics for Firebase
  • Firebase Crashlytics
  • Adapty

The Service Provider may disclose User Provided and Automatically Collected Information:

  • as required by law, such as to comply with a subpoena or similar legal process;
  • when they believe in good faith that disclosure is necessary to protect their rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
  • with trusted service providers who work on their behalf, do not have an independent use of the information disclosed to them, and have agreed to adhere to this privacy statement.

4. Opt-Out Rights

You can stop all collection of information by the Application easily by uninstalling it. You may use the standard uninstall processes available as part of your mobile device or via the mobile application marketplace or network.

5. Data Retention Policy

The Service Provider will retain user-provided data for as long as you use the Application and for a reasonable time thereafter. If you would like the Service Provider to delete user-provided data that you have supplied via the Application, please contact them at support@workoutnow.app, and they will respond within a reasonable time.

If data associated with an anonymous account is later linked to a registered account, retention of that data will follow the same rules as other personal data under this Privacy Policy.

6. Children

The Service Provider does not use the Application to knowingly solicit data from or market to children under the age of 13. The Application does not address anyone under the age of 13, and the Service Provider does not knowingly collect personally identifiable information from children under 13 years of age.

In the event that the Service Provider discovers that a child under 13 has provided personal information, they will immediately delete this information from their servers. If you are a parent or guardian and you are aware that your child has provided personal information, please contact the Service Provider at support@workoutnow.app so that they can take the necessary actions.

7. Security

The Service Provider is concerned about safeguarding the confidentiality of your information. They take precautions to protect the security of your information. They have physical, electronic, and managerial procedures to help safeguard, prevent unauthorized access, maintain data security, and correctly use your information. However, neither people nor security systems are foolproof, including encryption systems. In addition, people can commit intentional crimes, make mistakes or fail to follow policies. Therefore, while we use reasonable efforts to protect your personal information, we cannot guarantee its absolute security. If applicable law imposes any non-disclaimable duty to protect your personal information, you agree that intentional misconduct will be the standards used to measure our compliance with that duty.

8. Sale of Business

We reserve the right to transfer information to a third party in the event of a sale, merger, or other transfer of all or substantially all of the assets of WorkoutNow, owned and operated by The Service Provider or any of its Corporate Affiliates (as defined herein), or that portion of WorkoutNow, owned and operated by The Service Provider or any of its Corporate Affiliates to which the Service relates, or in the event that we discontinue our business or file a petition or have filed against us a petition in bankruptcy, reorganization, or similar proceeding, provided that the third party agrees to adhere to the terms of this Privacy Policy.

9. Affiliates

We may disclose information (including personal information) about you to our Corporate Affiliates. For purposes of this Privacy Policy, "Corporate Affiliate" means any person or entity which directly or indirectly controls, is controlled by, or is under common control with WorkoutNow, owned and operated by The Service Provider, whether by ownership or otherwise. Any information relating to you that we provide to our Corporate Affiliates will be treated by those Corporate Affiliates in accordance with the terms of this Privacy Policy.

10. Governing Law

This Privacy Policy is governed by the laws of Poland without regard to its conflict of laws provisions. You consent to the exclusive jurisdiction of the courts in connection with any action or dispute arising between the parties under or in connection with this Privacy Policy, except for those individuals who may have rights to make claims under other applicable international frameworks.

The laws of Poland, excluding its conflicts of law rules, shall govern this Privacy Policy and your use of the Application. Your use of the Application may also be subject to other local, state, national, or international laws.

By using WorkoutNow, owned and operated by The Service Provider, or contacting us directly, you signify your acceptance of this Privacy Policy. If you do not agree to this Privacy Policy, you should not use the Application. Continued use of the Application, direct engagement with us, or following the posting of changes to this Privacy Policy that do not significantly affect the use or disclosure of your personal information will mean that you accept those changes.

11. Tracking Technologies

We may use various tracking technologies to enhance your experience and understand how the Application is used.

  • Local Storage: Local Storage, sometimes known as DOM storage, provides web apps with methods and protocols for storing client-side data. Web storage supports persistent data storage, similar to cookies but with a greatly enhanced capacity and no information stored in the HTTP request header.
  • Sessions: WorkoutNow uses sessions to identify the areas of the Application or website that you have visited. A session is a small piece of data stored on your computer or mobile device by your web browser.

12. Information about General Data Protection Regulation (GDPR)

We may be collecting and using information from you if you are from the European Economic Area (EEA). In this section of our Privacy Policy, we explain how and why this data is collected and how we maintain this data under protection from being replicated or used in the wrong way.

13.Individual Data Subject's Rights – Data Access, Portability and Deletion

We are committed to helping our customers meet the data subject rights requirements of GDPR. WorkoutNow, owned and operated by The Service Provider, processes or stores all personal data in fully vetted, DPA compliant vendors. We store conversation and personal data for up to 6 years unless your account is deleted. In that case, we dispose of all data in accordance with our Terms of Service and this Privacy Policy, but we will not retain it longer than 60 days.

If you are working with EU customers, you may need to provide them with the ability to access, update, retrieve, and remove personal data. We support these requirements and give you access to your data and your customers' data. Our customer support team is available to answer any questions you might have about working with our APIs or exercising these rights.

14. California Residents

The California Consumer Privacy Act (CCPA) requires us to disclose the categories of personal information we collect and how we use it, the categories of sources from whom we collect personal information, and the third parties with whom we share it, which we have explained above.

We are also required to communicate information about rights California residents have under California law. You may exercise the following rights:

  • Right to Know and Access: You may submit a verifiable request for information regarding: (1) categories of personal information we collect, use, or share; (2) purposes for which categories of personal information are collected or used by us; (3) categories of sources from which we collect personal information; and (4) specific pieces of personal information we have collected about you.
  • Right to Equal Service: We will not discriminate against you if you exercise your privacy rights.
  • Right to Delete: You may submit a verifiable request to close your account and we will delete personal information about you that we have collected, subject to applicable legal exceptions.
  • Right to Opt Out of Sale: You may request that a business that sells a consumer's personal data not sell your personal data.

If you make a request, we have one month to respond to you. If you would like to exercise any of these rights, please contact us using the details provided in this Privacy Policy. We do not sell the personal information of our users.

15. Changes

This Privacy Policy may be updated from time to time for any reason. The Service Provider will notify you of any changes to this policy by updating this page with the new Privacy Policy. You are advised to consult this Privacy Policy regularly for any changes, as continued use of the Application is deemed approval of all changes.

This privacy policy is effective as of 2025-12-05.

16. Your Consent

We've updated our Privacy Policy to provide you with complete transparency into what is being set when you use the Application and how it is being used. By using our app, registering an account, or making a purchase, you hereby consent to our Privacy Policy and agree to the processing of your information as set forth in this Privacy Policy, now and as amended by the Service Provider.
